Mimoco is giving away 26 different MIMOBOT® designer USB flash drive characters over the next 26 days via Twitter. In order to be eligible to win, you must be a registered Twitter user with a public account (or register for and use a Twitter account which is public) follow @mimobot, and be at least 18 years old. No purchase is necessary to enter or win.
Sponsor: Mimoco, Inc. is the sponsor (“Sponsor”) of the ALPHABOT MIMOBOT® Twitter Contest (the “Promotion”).

The ALPHABOT MIMOBOT® Twitter Contest begins at 09:00 PM Eastern Standard Time (EST) on November 29, 2011, and runs through December 25, 2011 at 08:59 PM EST (the “Promotion Period”). Each daily promotion (“Daily Promotion”) runs for a 24 hour period beginning at 09:00 PM EST each day during the Promotion Period and ending at 08:59 PM EST the following day during the Promotion Period. Twitter’s messaging time stamp is the official timekeeping device for the ALPHABOT MIMOBOT® Promotion.

Every day during the Promotion Period, Mimoco will award a 4GB MIMOBOT® designer USB flash drive for a total of 26 devices awarded during the course of the Promotion. At its sole discretion, Mimoco will choose which MIMOBOT flash drives are available to win. Winners will be able to choose which MIMOBOT drive they will receive from that day’s selection. Each winner will be responsible for any federal, state or local taxes associated with the receipt or use of any prize, if any.

• Follow @mimobot on Twitter (your account may not be private so we can track the #playAlphabot hashtag).
• Each day of the ALPHABOT MIMOBOT® Promotion on or around 09:00 PM Eastern Standard Time (EST), Mimoco will tweet the Letter of the Day (LOTD) and reveal the assortment of MIMOBOT flash drives on sale for the next 24 hours, which are also eligible for that day’s prize.
• At any time during the 24 hour period starting at 09:00 PM EST and ending at 08:59 PM EST the next day, tweet a message to @mimobot by filling in the blank of the following sentence: “I would ___ for a 32GB @mimobot right now! #playAlphabot” using any word starting with the Letter of the Day (please capitalize the LOTD and do not use quotes around your entry). I.e., for day one, LOTD = A, the following two examples are both eligible entries:
• I would Argue with your mom for a 32GB @mimobot right now! #playAlphabot
• I would eat three hundred Apples for a 32GB @mimobot right now! #playAlphabot

 

• One person per day during the ALPHABOT MIMOBOT® Promotion who enters the contest by tweeting to @mimobot with a word starting with the Letter of the Day by filling in the blank of following sentence: “I would ___ for a 32GB @mimobot right now! #playAlphabot” (the “ALPHABOT Tweet”) within the specified time period will be randomly chosen to win that day’s MIMOBOT flash drive.
• Mimoco will announce the daily winner when the next Letter of the Day is announced on or around 09:00 PM EST.
• Only one entry per contestant, per day is eligible to qualify for the Daily Promotion, i.e., more than one entry per day will not increase your odds of winning on any one day, however you may enter as many times per day as you wish.
• Only one win per person will be permitted for the duration of the Promotion, though winners can continue to play to boost the amount of Memory for their devices, as described below.
• The Daily Winner prize will ship free of charge via UPS Ground. You’ll receive an email once the package ships with a tracking number. UPS Ground takes 1 to 6 business days, depending on the shipping address. See shipping rules for contest winners in our FAQ.
• Winners grant Mimoco permission to use winner’s Twitter User Name and real name for advertising, publicity and other purposes as well as to list the winner’s Twitter User Name in the ALPHABOT MIMOBOT Twitter Contest Score Board.
• Participants in the contest must follow @mimobot and participants must continue to follow @mimobot for the duration of the Promotion Period to earn and retain Memory Boost Points, as described herein.
• Participants must maintain a public account on Twitter.
• Mimoco will notify winners of the Daily Promotion via Twitter Direct Message on or around 09:00 PM EST the following period his or her submission has been chosen (the “Daily Winner”). Mimoco will award the Daily Winner with a 4GB MIMOBOT® USB flash memory drive of the Winner’s choice from the assortment of characters chosen by the Company. To claim the prize, the Daily Winner will have to provide Mimoco his or her real name, mailing address, e-mail address, and phone number by Direct Message to @mimobot via Twitter or by email to alphabot@mimoco.com. Additionally, if the Daily Winner opts to participate in the Boost Your Memory opportunity, the Daily Winner must inform Mimoco as to the number of Boost Points being redeemed via the same methods.
• If any Daily Winner fails to respond to @mimobot with shipping information by December 31, 2011, the Daily Winner forfeits his or her prize.
• Daily Winner’s may opt to trade their winning Letter of the Day with other Daily Winner’s listed on the Scoreboard. To arrange for a trade, each Daily Winner should communicate their interest with the other Daily Winner. Once a trade has been arranged between two Daily Winners, both Winners must DM @mimobot or email alphabot@mimoco.com to confirm the trade. Mimoco will confirm the trade by swapping the Daily Winner’s names on the Scoreboard.

 

Mimoco is not responsible for (i) electronic transmissions that are incomplete, garbled, inaccurate or not received by it for any reason; (ii) any problems or technical malfunctions, errors, omissions, interruptions, deletions, defects, delays in operation or transmission, communication failures or human error that may occur in the transmission, receipt or processing of entries; (iii) destruction of or unauthorized access to, or alteration of, entries; (iv) failed or unavailable hardware, network, software or telephone transmissions, damage to participant’s or any person’s computer or its contents, or any other causes that jeopardize the administration, security, fairness, integrity or proper conduct of this promotion; or (v) misrepresentation, cheating or fraud by any participant. Mimoco reserves the right to cancel or modify the ALPHABOT MIMOBOT® promotion if fraud, technical failures, unauthorized intervention or any other factor beyond Mimoco’s reasonable control impairs the integrity of the promotion, as it determines in its sole discretion. In such event, Mimoco reserves the right to judge entries from among the eligible, non-suspect entries received up to the time of the impairment.

Except where prohibited, each participant agrees that: (1) any and all disputes, claims and causes of action arising out of or connected with this Contest or any prize awarded shall be resolved individually, without resort to any form of class action, and exclusively by the United States District Court of Massachusetts or the appropriate District Court of the Commonwealth of Massachusetts; (2) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this Promotion, but in no event attorneys’ fees; and (3) under no circumstances will participant be permitted to obtain awards for, and entrant hereby waives all rights to claim, indirect, punitive, incidental and consequential damages and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased. All issues and questions concerning the construction, validity, interpretation and enforceability of these rules, construed and interpreted under the laws of the Commonwealth of Massachusetts. Participants agree to be bound by these rules and the decisions of Mimoco, the promotion’s sponsor, which are final and binding in all respects.

The more you play, the bigger your prize! Daily Winners may boost the Memory capacity of the Mimobot prize by continuing to participate in the Promotion. Though Participants may only win once, Mimoco will keep track of how many qualifying ALPHABOT Tweets were submitted. Every day you successfully tweet a phrase using Letter of the Day, Mimoco will award you a Memory Boost Point. Tweet enough ALPHABOT Tweets, and your winning MIMOBOT drive will be increased in capacity, depending on how many Memory Boost Points you’ve earned.

• 8 or more = your MIMOBOT prize is boosted to 8GB
• 16 or more = 16GB
• 23 or more = 32GB
• Only one Memory Boost Point may be earned per day by using the Letter of the Day.
• To redeem Memory Boost Points, you must be chosen as one of the 26 Daily Winners.

 

If you’re one of the lucky 26 Daily Winners, you may choose to trade your MIMOBOT with any other Daily Winner should they be willing to trade with you.

• We will post all winners Twitter names with their MIMOBOT prizes on a Score Board to keep track of who won what character and if it has been redeemed or is still earning Memory Boost Points.
• You may choose to redeem your MIMOBOT prize at any time. However, if you wish to boost your memory capacity, you may only redeem your MIMOBOT after you’ve earned enough Memory Boost Points to qualify for your boosted MIMOBOT memory.
• You may also choose to trade your MIMOBOT with any other winner by simply connecting with them via twitter or any other means. If you both wish to trade, both winners simply Direct Message (DM) @mimobot on Twitter or email alphabot@mimobot.com with the following message: “@YourTwitterName wishes to trade YourMimobotLOTD with @YourTwitterTradingFriend for TheirMimobotLOTD.”
• If you make a trade, your Memory Boost Points can be redeemed for your final MIMOBOT prize.
• Once a Daily Winner notifies @mimobot that he or she wishes to redeem their MIMOBOT prize, no more Memory Boost Points may be earned.
