• Step 2: Reply @mimobot using the Word of the Day (WOTD) in a sentence during the 24 hour window. (NOTE: The WOTD can be used as part of another word. ie, thanksgiving, thankful, thanks are all valid entries if the WOTD = thank. Moreover, plural forms of the WOTD are also valid entries. ie, memories is a valid entry if WOTD = memory.)
• Step 3: Every day at 12:01AM a winner will be randomly chosen to receive a MIMOBOT designer USB flash drive.

• Every day is a new chance to win. Each day at 12:01AM Eastern Standard Time (EST) through December 26, 2008, @mimobot will tweet the WOTD (which can also be obtained from the scoreboard calendar below).

400,000 MEGABYTE MIMOBOT® Twitter Contest Rules:

Mimoco is giving away 50 different MIMOBOT® designer USB flash drive characters over the next 50 days via Twitter. In order to be eligible to win, you must be a registered Twitter user, follow mimobot, and be at least 18 years old. No purchase is necessary to enter or win.

Mimoco, Inc. is the sponsor of the 400,000 MEGABYTE MIMOBOT® Twitter Contest (the "Promotion").

Promotion Period:
The 400,000 MEGABYTE MIMOBOT® Twitter Contest begins at 12:01 AM Eastern Standard Time (EST) on November 7, 2008, and runs through December 26, 2008 at 11:59 PM EST (the “Promotion Period”). Each daily promotion (“Daily Promotion”) begins at 12:01 AM EST each day during the Promotion Period and ends at 11:59 PM EST each day during the Promotion Period. Twitter’s messaging time stamp is the official timekeeping device for the 400,000 MEGABYTE MIMOBOT® Promotion.

Prizes:
Every day during the Promotion Period, Mimoco will award a 1GB MIMOBOT® designer USB flash drive for a total of 50 devices during the course of the Promotion. Mimoco will choose which MIMOBOT design to award at their discretion, and no winner will be able to choose which character he or she will receive, although winners may choose to trade amongst themselves. Each winner will be responsible for any federal, state or local taxes associated with the receipt or use of any prize, if any.

To enter the 400,000 MEGABYTE MIMOBOT Promotion:

• Follow mimobot on Twitter.
• Each day of the 400,000 MEGABYTE MIMOBOT® Promotion at 12:01 AM Eastern Standard Time (EST), Mimoco will tweet either a word or phrase that is the Word of the Day.
• Sometime between 12:01 AM EST and 11:59 PM EST, tweet @mimobot a sentence using that day’s Word of the Day.
• One person per day during the 400,000 MEGABYTE MIMOBOT® Promotion who replies @mimobot and uses the Word of the Day in a sentence within the specified time period will be randomly chosen to win that day’s MIMOBOT.
• Mimoco will reveal the daily winner and MIMOBOT character when the next Word of the Day is announced at 12:01 AM EST the following day.

Promotion Rules:

• Only one entry per contestant, per day is eligible to qualify for the Daily Promotion, i.e., more than one entry per day will not increase your odds of winning on any one day.
• Only one win per person will be permitted for the duration of the Promotion, though winners can continue to play to boost the amount of Memory for their devices.
• The Daily Winner prize will ship free of charge via UPS Ground. Winners will receive an email once the package ships with a tracking number. UPS Ground takes 1 to 6 business days, depending on the shipping address. See complete shipping rules for contest winners.
• Winners grant Mimoco permission to use winner’s Twitter User Name and real name for advertising, publicity and other purposes as well as to list the winner’s Twitter User Name in the 400,000 MEGABYTE MIMOBOT Twitter Contest Score Board.
• Participants in the contest must follow @mimobot and participants must continue to follow @mimobot for the duration of the Promotion Period to earn and retain Memory Boost Points, as described herein.
• Mimoco will notify winners of the Daily Promotion via Twitter Direct Message after his or her submission has been chosen (the “Daily Winner”). Mimoco will award the Daily Winner with a 1GB MIMOBOT® USB flash memory device of the Company’s choosing. To claim the prize, the Daily Winner will have to provide Mimoco his or her real name, mailing address, e-mail address and phone number by Direct Message to mimobot via Twitter. Additionally, if the Daily Winner opts to participate in the Memory Boost opportunity, the Daily Winner must inform Mimoco as to the number of Boost Points being redeemed.
• If any Daily Winner fails to respond to @mimobot with shipping information by December 31, 2008, the Daily Winner forfeits his or her prize.

The 400,000 MEGABYTE MIMOBOT Twitter Contest Memory Boost, Trading Zone and Score Board

Memory Boost:

Daily Winners may boost the Memory capacity of their MIMOBOT prize by continuing to participate in the Promotion. Though Participants may only win once, Mimoco will keep track of how many Words of the Day you tweet @mimobot. Every day you successfully tweet a phrase using the Word of the Day, Mimoco will award you a Memory Boost Point. Tweet enough of them, and your winning MIMOBOT drive will be increased in capacity, depending on how many Memory Boost Points you compile.

• 10 or more Words of the Day properly tweeted = your MIMOBOT prize is boosted to 2GB
• 25 or more = 4GB
• 42 or more = 8GB
• All tweets made @mimobot using the Word of the Day in a sentence will be accepted as MIMOBOT Memory Boost points.
• Only one Memory Boost Point may be earned per day by using the Word of the Day.
• To redeem Memory Boost points, you must be chosen as one of the 50 daily MIMOBOT winners.
• You may choose to redeem your MIMOBOT prize at any time. However, if you wish to boost your memory capacity, you may only redeem your MIMOBOT after you’ve earned enough Memory Boost Points to qualify for your boosted MIMOBOT memory.
• Once a Daily Winner notifies @mimobot via Direct Message that he or she wishes to redeem the MIMOBOT prize, no more Memory Boost Points may be earned.

Trading Zone:

If you’re one of the lucky 50 daily MIMOBOT winners, you may choose to trade your MIMOBOT with any other winner should they be willing to trade with you.

• You may choose to trade your MIMOBOT with any other winner by simply connecting with them via Twitter or any other means. If you both wish to trade, both winners simply Direct Message (DM) @mimobot on Twitter with the following message: “@YourTwitterName wishes to trade YourMIMOBOTprizeCharacter with @YourTwitterTradingFriendsName for TheirMIMOBOTprizeCharacter.”
• If you make a trade, your Memory Boost Points can be redeemed for your final MIMOBOT prize.

Additional Rules:

Mimoco is not responsible for (i) electronic transmissions that are incomplete, garbled, inaccurate or not received by it for any reason; (ii) any problems or technical malfunctions, errors, omissions, interruptions, deletions, defects, delays in operation or transmission, communication failures or human error that may occur in the transmission, receipt or processing of entries; (iii) destruction of or unauthorized access to, or alteration of, entries; (iv) failed or unavailable hardware, network, software or telephone transmissions, damage to participant’s or any person’s computer or its contents, or any other causes that jeopardize the administration, security, fairness, integrity or proper conduct of this promotion; or (v) misrepresentation, cheating or fraud by any participant. Mimoco reserves the right to cancel or modify the 400,000 MEGABYTE MIMOBOT® promotion if fraud, technical failures, unauthorized intervention or any other factor beyond Mimoco’s reasonable control impairs the integrity of the promotion, as it determines in its sole discretion. In such event, Mimoco reserves the right to judge entries from among the eligible, non-suspect entries received up to the time of the impairment.

Except where prohibited, each participant agrees that: (1) any and all disputes, claims and causes of action arising out of or connected with this Contest or any prize awarded shall be resolved individually, without resort to any form of class action, and exclusively by the United States District Court of Massachusetts or the appropriate District Court of the Commonwealth of Massachusetts; (2) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this Promotion, but in no event attorneys’ fees; and (3) under no circumstances will participant be permitted to obtain awards for, and entrant hereby waives all rights to claim, indirect, punitive, incidental and consequential damages and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased. All issues and questions concerning the construction, validity, interpretation and enforceability of these rules, construed and interpreted under the laws of the Commonwealth of Massachusetts. Participants agree to be bound by these rules and the decisions of Mimoco, the promotion’s sponsor, which are final and binding in all respects.
